The general conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relations between any user of the ZENANDSOUNDS.COM site (hereinafter referred to as a "User" or "You") whose headquarters social is located at 88, Boulevard de Charonne 75020 PARIS n ° SIRET: 834 332 793 00027.
These general conditions of sale are the only ones applicable and replace all other conditions. 3. Product information
Zen & Sounds takes the greatest care in posting information relating to the essential characteristics of the products, in particular by means of descriptions from its partners and suppliers and photographs illustrating the products. However, it is not compulsory that a product sheet contains all the technical characteristics.
The sale prices indicated on the Site are in euros and all taxes included, but excluding delivery costs. Any delivery costs are indicated to the User each time he chooses products and are invoiced to him at the end of the order in addition to the price of the selected products.
The prices appear in euros.
We reserve the right to modify our prices at any time (in particular because of the fluctuation of the exchange rates).
We will honor your order within the limits of our available stocks.
If one of the products ordered is not available in our stocks, we undertake to contact you by email within 7 days from the date of your order in order to inform you and indicate to you within what deadlines this product could be delivered to you. For products not stored with us, our offers are valid subject to availability from our suppliers. These indications on the availability of the products are provided to you when you place your order. This information coming directly from our suppliers, errors or exceptional modifications are beyond our control and cannot engage our responsibility.
The times indicated are average times and correspond to the times of treatment and delivery. In the case of items deliverable on different dates, taking into account their availability, the delivery time is based on the average time. To improve the service, ZENANDSOUNDS.COM however reserves the possibility of splitting the deliveries, this will be with your agreement (by phone or email). The participation in processing and shipping costs will only be invoiced for one shipment. ZENANDSOUNDS.COM cannot be held responsible for the consequences due to a delay in delivery. Any order not dispatched within 30 days of the order may be canceled by the User by simply sending an email).
The availabilities displayed are given for information only and do not in any way represent a contractual commitment.
6. Delivery method
Your order will be delivered to the address you provided when ordering.
We offer the following delivery method:
* Standard delivery
This choice of delivery allows you to receive your package within 3 to 5 working days thanks to the Post Office and the Colissimo service.
Note: During the coronavirus crisis, delivery times may be slightly extended, since La Poste does not pick up packages every day. Thank you for your understanding.
We do our best to respect the delivery times mentioned on the Site. However, we cannot be held responsible for the consequences due to a delay in delivery or loss of packages caused by a third party or by your act or due to an unforeseeable and insuperable cause constituting a case of force majeure.
In the event of non-receipt of a parcel within the time limits indicated, you have a period of 15 days to make a complaint to your nearest post office with your tracking number. An investigation will be opened, with file number. During this period, no refund or return can be made. (This except for voluminous items shipped by a carrier other than LA POSTE)
Mandatory procedure upon receipt:
In the presence of the carrier, you must:
- Imperatively check the package, both the exterior and the content in order to notify reservations if the product ordered is missing, incomplete or damaged
- If the package is damaged: put a reserve because without reserve, the insurance does not work
- If there is breakage: put a reserve, take photos and report it to us during the day
- If the delivery man does not let you open it to see the good condition of the content, you must note on the delivery note: "The delivery man refused that I check the content"
If you do not proceed in this way to receive your package, the money back or replacement guarantee will not work. It will then be necessary to see with your own insurance.
Without prejudice to the applicable legal guarantees, we recommend that you address any reservations regarding the lack of conformity of the products existing on the delivery date as soon as possible by sending a letter to Zen & Sounds 88 Boulevard de Charonne 75020 PARIS or email to contact @ zenandsounds.com .
If the products need to be returned to us, please send them to Zen & Sounds 88 Boulevard de Charonne 75020 PARIS. The return of products can only be accepted for products in their original state, with their packaging, accessories, and instructions for use. The shipping costs are at the expense of the User.
In the event of proven non-compliance, the User will have the choice between repairing or replacing the product unless the desired option entails a cost manifestly disproportionate to the other modality.
Finally, in the event of payment by check, we will only send the order when the check is cashed on our account.
In case of delivery failure:
The costs related to the failure of the delivery because of the Customer (return of the undelivered package) will be at the expense of the cutomer.
In the event of non-receipt of a parcel marked 'delivered' by post:
The mention "delivered" by post indicates that the seller has fulfilled his delivery contract. The seller is not responsible if a package mentioned 'delivered' by post is not received by the buyer. The buyer must contact the post office and launch an inquiry with these services. However, the post gives confidence to its staff and it is often difficult to obtain a refund.
When you click on the "Validate" button after the order process, you declare that you accept it as well as all of these General Conditions of Sale completely and fully. The data recorded on ZENANDSOUNDS.COM constitutes proof of all the transactions made by ZENANDSOUNDS.COM and its customers.
We currently use several payment methods: By CB for online payments. By check, transfer or credit card (for telephone orders).
For payment by check, you just need to send us, along with your order summary, your check made payable to Zen & Sounds. Upon receipt of your check, we will inform you of the receipt of that by email and we will dispatch your order as soon as the check is cashed on our account.
9. Right of withdrawal and returns.
In the case of a withdrawal or non-compliance, prior contact with ZENANDSOUNDS.COM must be established, no item will be accepted if it is not in its original packaging and will not be processed without being accompanied by a return agreement provided by ZENANDSOUNDS.COM .
For the products available and in stock, we allow you to benefit from the 14 clear days provided for in article L 121-20 of the Consumer Code) to return a product which does not satisfy you. You can return this product within this period, at your expense, accompanied by your invoice and a return authorization agreement which you will have obtained on request by email to: firstname.lastname@example.org and specifying the mode chosen (reimbursement or credit note).
Upon receipt of the agreement by email from Zen & Sounds, you have 14 days to return the product to us. This right of withdrawal is exercised without penalty. The return transport costs are your responsibility.
The withdrawal period concerns only new products and not second-hand, second-hand products are not subject to return or warranty.
For products that are the subject of a special order following your request (rare products manufactured or delivered to order) by email or telephone, we do not make returns.
Breakage and deterioration of a product:
The right of withdrawal does not apply to the receipt of a damaged, broken or cracked package. Returns for reasons of deterioration (cracks, breakage etc ...) are only accepted on sending a photo by email to email@example.com within 48 hours after receipt. After this period, no refund or exchange will be accepted.
The "breakage guarantee" is limited to the replacement of defective parts, repair, exchange or refund if the product were to be unusable. The instruments must reach Zen & Sounds carefully packed, carriage paid, and will be returned carriage paid (the costs of sending and returning the replaced product are at the expense of the customer). We then commit to take charge of any repairs from suppliers. Whatever the problem concerning your article, it is imperative to enclose with the defective products a copy of the invoice and an annotated return slip: "seen with ... name of the contact person at Zen & Sounds).
The "breakage guarantee" does not apply for products with a very specific procedure upon receipt (this special procedure is specified by the seller to the buyer). If the buyer does not respect the special procedure announced by the seller by email (like checking the product in front of the deliveryman, postman or in the relay or post office) there will be no possible refund.
The "breakage guarantee" does not cover wear or tonal qualities. The warranty automatically lapses in the event of misuse, authorized technical modification or repair carried out by a workshop not approved by Zen & Sounds.
The warranty does not cover the repair of damage resulting from:
* from a cause external to the instruments (for example, accident, shock, breakage or crack due to transport, etc.),
* fault of the customer resulting for example from use or non-use not in accordance with the manufacturer's specifications,
* of a use harmful to the good conservation of the product,
* commercial or collective use, the use of unsuitable utensils, cleaning products, accessories or consumables.
* intervention by a repairer not approved by Zen & Sounds
* faults and their consequences linked to any external cause.
In the event that the repair is not covered, the manufacturer will draw up an estimate.
Administrative costs will be requested from the manufacturer in the event of refusal to pay this estimate. If the quote is agreed, a check, payable to Zen & Sounds and corresponding to the amount of the quote, will be sent to us.
The guarantees mentioned in this paragraph are not transferable in the event of the instrument being sold to a third party.
Method of refund:
During a refund, the user is reimbursed by bank transfer or by check or paypal if the payment has been made by the latter.
Return of the package:
Only products in new and complete condition (accessories, manuals, etc.) will be accepted, returned in their original packaging and sent to:

We advise you to return the goods by registered or tracked colissimo and possibly to subscribe to an insurance with the carrier of the market value of the products. This is necessary in the event of theft or loss of this merchandise by their services. In all cases the return is made at the expense and risk of the consumer.
We decline all responsibility in the event that the item to be exchanged does not reach us. No inquiry with the Postal Services, nor Refund or Exchange can then be carried out. Any product that has been damaged, or whose original packaging has been damaged in conditions beyond its simple opening, will not be refunded, or partially refunded under the conditions indicated below.
If the article is returned incomplete or damaged to Zen & Sounds, a price reduction will be applied according to the diagnosis made by us. We will justify to the customer the application of this discount by communicating a document drawn up by us.
Cancellation of the order :
In case of cancellation of the order by the Customer, Zen & Sounds will proceed, within 30 days from the cancellation, to refund the price of the order after deduction of the shipping costs paid by the seller and processing generated by the order (5%). In the case of a return of an order which has benefited from the offer of free shipping costs, the recipient will be refunded for the items returned minus the actual shipping costs paid by the seller when sending the package.
10. Litigation and responsability
This contract is subject to French law.
The proposed products comply with current French legislation and the standards applicable in France. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of Zen & Sounds cannot be engaged in the event of an error or omission in any of these photographs, texts or graphics, information or characteristics of the products or in the event of modification of the characteristics of the products by the suppliers. .
Zen & Sounds cannot be held responsible for the non-performance of the contract concluded in the event of a stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and / or communications , flood, fire. Zen & Sounds will not incur any responsibility for any indirect damage because of the present, loss of exploitation, loss of profit, loss of chance, damage or costs, which could arise from the purchase of the products. We remind you that it is prudent to save the data contained in the products purchased. Zen & Sounds cannot be held responsible for any loss of data, files or damage defined in the previous paragraph. Zen & Sounds cannot be held liable in the event of non-compliance with the legislation of the country where the products are delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services that you plan to order.
This contract is subject to French law. The language of this contract is French. In the event of a dispute, the courts of Paris (France) will be competent.
11: In case of breakage during transport
IMPORTANT: In addition to the guarantees described in these General Conditions of Sale, Zen & Sounds does not provide any other guarantee.
12: Parcel processing: no longer lives at the address indicated / unclaimed / refused
If your package is returned by our service provider for the following reason:
* NPAI (Does not live at the indicated address)
* Parcel not claimed during its legal period
* Package refused by the recipient upon delivery
You will be redirected to the customer in exchange of a new payment of the shipping costs.
13: Lost or damaged parcel
For any reason whatsoever, if the package sent by Zen & Sounds did not arrive at its destination and this despite a colissimo number indicating the opposite, then the customer will be invited to contact the post office nearest to his home ( accompanied by the colissimo number). Zen & Sounds cannot be held responsible for a package supposedly delivered by La Poste to its customer, which the latter declares not to have received. In this case, Zen & Sounds reserves the possibility of compensating its customer, in the form of vouchers equivalent to the value of the package. No voucher can be refunded in cash.
Also, if the customer notices that his package, whether at the time of delivery of the package to his home or of its withdrawal at a post office, showed anomalies (deterioration of the package, opening of the package ...), he can :
- refuse it by marking the reason "refusal" on the postal voucher. The customer must then complete the procedure provided for this purpose in a post office and send it by registered post with acknowledgment of receipt within 3 clear days of delivery of the package to the Post Office and to Zen & Sounds customer service.
- accept it by indicating his reservations on the postal delivery slip which he signs against obtaining his package. Then, he must within 3 clear days send an explanatory letter to Zen & Sounds accompanied by a copy of the delivery slip of the post signed and stamped.
In the event that the customer claims not to have received one or more products, and that Zen & Sounds noted an anomaly between the weight of the parcel supported by the post and that of the products claimed on arrival, Zen & Sounds does not is not required to reimburse his client.
Any package accepted by the customer will be considered as a delivered package (delivery date of the post in colissimo delivery). Failure to comply with the procedures set out below, no claim by the buyer will be accepted.
In the event of a lost package, the customer has the option of asking Zen & Sounds to conduct a postal inquiry. If it reveals that La Poste is responsible for the loss of the package, Zen & Sounds will repay its customer up to the refund made by La Poste if the package has been insured.
14. Intellectual property
All the texts, comments, works, illustrations and images reproduced on the "Zenandsounds.com" site are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code. Any other use constitutes counterfeiting and sanctioned under Intellectual Property unless prior authorization from Zen & Sounds.
15. Protection of personal data
The information that you communicate to us is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts, their absence results in the cancellation of your order. By registering on the Site, you agree to provide us with sincere and true information about yourself. The communication of false information is contrary to these general conditions as well as to the conditions of use appearing on the Site.
If you accepted it during your identification on the Site, promotional emails (emails) offering news, advice, etc. will be sent to you. Zenandsounds.com undertakes not to disclose to third parties the information that you communicate to us. These are confidential. They will only be used by its internal services for the processing of your order and to strengthen and personalize the communication between you and us, in particular by the Zenandsounds.com newsletters to which you will have subscribed.
GENERAL CONDITIONS OF SALE FOR ZEN & SOUNDS RETREATS
Places in Zen & Sounds retreats are bookable by paying a deposit for each individual booking, which varies according to the retreat and its content. All deposits are non-refundable and non-transferable, except in the event that cancellation is decided by the organizers. *
Payment of the balance is due a maximum of 30 days before the first day of retirement. We will not send a reminder email. If we do not receive your payment of the outstanding balance, your place may be reserved by another participant.
Terms of cancelation :
Deposits: All deposits are non-refundable and non-transferable, except in the case where the cancellation is decided by the organizers. *
Full Payments - For seats paid for in full and then canceled, the following applies:
More than 4 weeks before the start of the retreat: 100% refund less the deposit.
2 to 4 weeks before the start of the retreat: 50% reimbursement minus the deposit.
From 2 weeks before the start of the retreat: no refund will be made.
* In the event of cancellation of the retreat by the organizers, all deposits and payments made by participants will be fully refunded. This reimbursement does not take into account plane tickets and / or any other transport booked by the participants. IT IS THEREFORE STRONGLY ADVISED TO PROVIDE CANCELLATION INSURANCE FOR YOUR TRANSPORT TICKETS.
IT IS RECOMMENDED TO TAKE TRAVEL INSURANCE IN THE EVENT YOU HAVE TO CANCEL due to unforeseen circumstances.
Due to teacher cancellations, low bookings or other situations beyond our control, some classes may be temporarily or permanently unavailable. We reserve the right to make changes to our programs, courses or teachers. In this case, we will offer possible arrangements under the best conditions that we can offer. We cannot be held responsible for all costs incurred, including airline tickets. IT IS THEREFORE STRONGLY ADVISED TO PROVIDE CANCELLATION INSURANCE FOR YOUR TRANSPORT TICKETS.
If the retreat organizer decides to offer a discount to certain participants, or reduced last minute rates, this does not affect the status of participants who have already paid the full rate and no discount will be due.
Zen and Sounds accepts no responsibility for any loss, damage, injury or illness, which may occur during retreat, or while traveling to or leaving the Zen and Sounds retreat. He is strongly recommended that participants have their own travel insurance covering any loss or damage, including repatriation if necessary.
Zen and Sounds takes all measures to ensure that participants in physical activities are not pushed beyond the limit of their abilities. In the event of a particular pre-existing injury or any illness, we ask you to indicate it to the teacher, and we ask you to also indicate to him that you find the course too difficult if that is your feeling. We advise that in case of pain or illness during the course, you stop and rest.
